Terms and Booking Conditions

Our gite is offered for holiday rental subject to the following terms and conditions, effective 12th September 2010. Please make sure that you have read and understand them.

Definitions

Booking Procedure

  1. To make a reservation, the Client should send an email to dkillip@gitevendee.co.uk stating the following :- name, address, contact telephone number, number in party, date of arrival and date of departure. The Owner will issue a Provisional Booking Confirmation.
  2. To secure the reservation, the Client should pay a non-refundable deposit of 20% to the Owner. The Owner will issue a Booking Confirmation. This constitutes formal acceptance of the booking by the Owner.
  3. The balance is payable not less than eight weeks before the start of the rental period. If payment is not received by the due date, the Owner reserves the right to give notice in writing that the reservation is cancelled.
  4. In the case of reservations made within eight weeks of the start of the rental period, full payment will be requested by the Owner at the time of booking.

Cancellation by the Client

  1. The Client should inform the Owner via email of their intention to cancel the booking
  2. In the event that the Client is obliged to cancel the booking, no monies will be refunded to the Client.

Cancellation by the Owner

  1. In the event that the Owner is obliged to cancel the booking, all monies paid by the Client to date will be refunded to the Client in full. This is the limit of the Owner's liability.

Arrival & Departure

  1. In general, the day of arrival and the day of departure is Saturday.
  2. The rental period shall start at 4.00 p.m. on the day of arrival and finish at 10 a.m. on the day of departure. The Owner shall not be obliged to offer the Property before the start of the rental period and the Client shall not be entitled to remain in the Property after the end of the rental period.

Security Deposit

  1. A security deposit in of £200 will be paid by the Client, along with the balance of payment. The security deposit will be refunded in whole or in part within two weeks after depature. Any breakages, losses or damage, not attributable to normal wear and tear, and any extra costs or charges will be deducted from the security deposit. Should the security deposit be insufficient to meet such costs or liabilities, an additional amount will be requested from the Client.

Occupancy

  1. The maximum occupancy of the Property must not exceed that detailed in the Booking Confirmation, unless the Owner has given written permission.

General Conditions

  1. The swimming pool is available for the Client to use but the saftey is the responsibility of the Client and the cover must be used when not in use.
  2. Smoking is not allowed at the Property.
  3. Pets or animals are not allowed.
  4. Camping is not allowed within the grounds of the Property.

Client Responsibilities

  1. The Client agrees to be a considerate tenant and to take good care of the Property
  2. The Client is responsible for cleaning the Property during the rental period and before departure.
  3. The Client should leave the Property in a clean and tidy condition at the end of the rental period. This includes washing up, cleaning oven and microwave, cleaning shower, basin and toilet and brushing floor.
  4. The Owner reserves the right to make a retention from the security deposit to cover additional cleaning costs if the Client leaves the Property in an unacceptable condition.
  5. The Client agrees not to act in any way, which would cause disturbance to those residents in neighbouring properties.
  6. The Client acquires no rights whatsoever over the Property excepting occupation as a holiday let for the rental period. The Client shall not sub-let the Property.
  7. The Client shall report to the Owner without delay any defects in the Property or breakdown of equipment in the Property and its facilities and arrangements for repair and/or replacement will be made by the Owner as soon as possible.

Insurance

  1. It is recommended that the Client arranges a comprehensive travel insurance policy, including cancellation cover. All visitors to France are advised to bring with them a valid E111 health card or equivalent.

Disclaimers

  1. The use of the Property and facilities where offered such as the swimming pool, is entirely at the Client's risk.
  2. The Owner shall not be liable to the Client whatsoever
    • For any loss or inconvenience caused to the Client if the Client needs to depart from the Property before the end of the rental period. In such an event, no monies will be refunded to the Client.
    • For any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, machinery or appliance in the Property and its facilities.
    • For the loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner.
    • For any loss, damage or inconvenience caused to or suffered by the Client if the Property shall be destroyed or substantially damaged before the start of the rental period. In such an event, the Owner shall inform the Client and refund to the Client all monies paid by the Client to date .
  3. The Owner will accept no responsibility whatsoever
    • For any injury, damage or loss to the Client or a member of the Client's party or any of their property whilst using the Property and its facilities.
    • For any damage or loss to any motor vehicle or its contents.
  4. Under no circumstances shall the Owner's liability to the Client exceed the amount paid to the Owner for the rental period.

Disputes

  1. In the event of any disputes that cannot be resolved between the Client and the Owner, the courts of Great Britain shall have jurisdiction.

Acceptance of these Terms and Conditions

  1. Payment of the booking deposit by the Client constitutes a formal acceptance of these Terms and Conditions
